These Terms of Service (“Terms”) govern your use of the Spotty Elephant CRM website and platform (“Service”), operated by Lean4Sales Ltd, trading as Spotty Elephant.

By using our site or services, you agree to these Terms. If you do not agree, please do not use our services.

1. Use of the Service

Spotty Elephant CRM is a cloud-based customer relationship management (CRM) tool, designed to help businesses manage their contacts, pipelines, communications, and campaigns.

You must be at least 18 years old to use the platform and provide accurate information when registering an account.

2. User Responsibilities

You agree not to:

-Use the platform for any unlawful or unauthorised purpose

-Upload viruses or malicious code

-Attempt to reverse engineer, copy, or exploit the platform

-Use the platform to send spam or unsolicited marketing

You are responsible for the content you store, upload, or send through the CRM platform.

3. Data & Privacy

Our Privacy Policy and Cookie Policy govern how we collect, use, and protect your personal and customer data. As a CRM user, you are the data controller of your customer data. We act as a data processor, following your instructions.

You are responsible for ensuring you have a lawful basis to collect and store the data you input into the platform.

4. Account Security

You are responsible for safeguarding your login credentials. Notify us immediately if you suspect unauthorised use.

5. Payment & Subscriptions

Access to Spotty Elephant CRM is subject to a subscription fee. Pricing is available on our website or upon request.

-All payments are billed in GBP and subject to VAT

-We reserve the right to update pricing with notice

-Non-payment may result in suspension of service

6. Intellectual Property

All content, code, branding, and designs within Spotty Elephant CRM remain the intellectual property of Lean4Sales Ltd. You may not copy or reuse elements of the platform without written permission.

7. Termination

You may ask for a refund at any time for an order that is incomplete. An incomplete order is one that has never been unblocked. Once unblocked, by us or any other entity, it will be considered a complete job and no longer eligible for a refund.

8. Service Availability

We aim to provide uninterrupted service but cannot guarantee 100% uptime. Scheduled maintenance and unplanned outages may occur.

We are not liable for any loss of business or data due to downtime.

9. Limitation of Liability

To the fullest extent permitted by law, Spotty Elephant CRM and its operators are not liable for:

- Indirect or consequential damages

- Loss of data, revenue, or profit

- Service interruptions beyond our control

Our total liability shall not exceed the fees paid in the last 12 months.

10. Changes to Terms

We may update these Terms from time to time. Changes will be posted on this page with a new "Last Updated" date. Continued use of the service implies acceptance of changes.

11. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the UK courts.
