Terms of Service

These Terms & Conditions are issued by Lean 4 Sales Ltd (“we”, “us”, “our”). Spotty Elephant CRM is a non-trading brand of Lean 4 Sales Ltd.

These terms govern your access to and use of the Spotty Elephant CRM service (“the Service”). By using the Service, you agree to these Terms & Conditions.

1. Use of the Service

The Service is provided for lawful business use only. You must not misuse the Service, attempt unauthorised access, or interfere with its normal operation.

2. Accounts & Access

You are responsible for all activity carried out under your account and for ensuring that login credentials are kept secure.

3. Service Access for Support, Consultancy & Maintenance

Where required to deliver the Service, provide consultancy or support services, or perform maintenance, we may access the Service and customer accounts on a limited and controlled basis.

Such access will be for legitimate business purposes only, limited to what is reasonably necessary, and carried out in accordance with applicable data protection legislation.

4. Customer Data

You retain ownership of all data entered into the Service.

We store and process this data solely for the purpose of providing and improving the Service and do not sell customer data.

5. Data Protection

Each party agrees to comply with applicable data protection legislation, including UK GDPR.

The Service is not intended for the storage of special category or highly sensitive personal data unless explicitly agreed in writing.

6. Service Availability

We take reasonable steps to ensure the Service is available and reliable. However, uninterrupted or error-free operation is not guaranteed.

7. Fees & Payment

Subscription fees are payable monthly in advance and are non-refundable unless required by law.

Consultancy services are charged separately in accordance with agreed proposals.

If payment of any undisputed invoice is not received by the due date, we reserve the right, following reasonable notice, to suspend access to the Service and/or pause consultancy services.

8. Purchase Orders

Purchase order numbers may be provided for reference only and do not override these Terms & Conditions.

9. Intellectual Property

All intellectual property rights in the Service remain the property of Lean 4 Sales Ltd.

10. Limitation of Liability

Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim.

11. Governing Law

These Terms are governed by the laws of England and Wales.
